The West Bengal Board of Primary Education is represented although learned counsel claims that he has not received the copy of the writ petition. The State is represented.
The limited prayer of the petitioners is for a communication dated 11th September, 2019 to be acted upon by the Secretary, West Bengal Board of Primary Education in relation to payment of salary and honourarium to the petitioners from April to June, 2017 and from April, 2019 till date.
The petitioner no. 1 serves as a Data Entry Operator and the petitioner no.2 is a Group -D employee in the District Primary School Council, Hooghly. According to the learned counsel appearing on behalf of the petitioners, despite several communications from 2015 onwards till 2019, West Bengal Board of Primary Education has not acted upon the same. The letter of the Deputy Secretary, School Education Department, Government of West Bengal,
dated 11th September 2019 to the Secretary, West Bengal Board of Primary Education referring to the case of the petitioners and directing the Secretary, West Bengal Board of Primary Education to take necessary action and send action taken report to the School Education Department has also not been acted upon.
Upon considering the relevant materials on record, this Court is of the view that the Secretary, West Bengal Board of Primary Education, being the respondent no. 6, should be directed to send an action taken report to the School Education Department on the basis of the letter dated 11th September, 2019 within three weeks from date. A copy of such report shall be sent by the School Education Department to the petitioners within two weeks from the date on which such report is received by the said department. The petitioners thereafter shall be at liberty of taking appropriate steps.
WPA 14698 of 2021 is disposed of in terms of above.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
