The petitioner is aggrieved by non-consideration of his representation made to the Regional Transport Authority and the District Magistrate, Purba Medinipur whereby the petitioner has requested for deletion of the name of Mr. N.R. Pradhan from the permit in respect of the vehicle i.e. owned and plied by the petitioner on the route Haldia to Mecheda Railway Station via NH 41 and back.

The petitioner submits that initially the permit was granted in the name of the petitioner and one Mr. N.R. Pradhan. The petitioner and the said Mr. N.R. Pradhan were plying the vehicle on the route specified in the permit. However, subsequently, Mr. N.R. Pradhan joined the Defence Forces whereafter Mr. N.R. Pradhan affirmed an affidavit before the Notary Public at Tamluk thereby confirming that he had joined the Defence Forces and

that, he wished to transfer the vehicle in the name of the petitioner. The petitioner complaints that despite having made appropriate application with requisite fees, the petitioner's request for transferring the permit solely in the name of the petitioner (or deleting the name of Mr. N.R. Pradhan from the permit) has not been considered. The petitioner submits that in such regard, the petitioner made a representation before the respondent no.2, which was received by the office of the respondent nos.2 and 3 on June 9, 2025. Such representation has not yet been considered and disposed of.

Learned advocate appearing for the State submits that the authority concerned shall consider and dispose of the representation of the petitioner, in accordance with law.

Having heard the learned advocates appearing for the respective parties and having considered the material on record, it appears that no useful purpose will be served by keeping this writ petition pending. This writ petition is, therefore, disposed of by directing the respondent no.2, i.e. Regional Transport Authority, Purba Medinipur to consider and dispose of the petitioner's representation received by the office of the District Magistrate, Purba Medinipur on June 9, 2025 (which forms annexure P-6 to the writ petition at page 37 thereof) within a period of six weeks from the date of communication of this order, strictly in accordance with law upon giving an opportunity

of hearing to the petitioner.

Needless to mention that the respondent no.2 shall dispose of the said representation by passing a reasoned order within the aforesaid period and shall communicate such reasoned order to the petitioner within a week from the date of passing thereof.

It is made clear that this Court has not gone into the merits of the case and the respondent no.2 shall be free to take a decision on the petitioner's representation, strictly in accordance with law.

With the above observations, WPA 13679 of 2025 is disposed of.

There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.)
