The learned advocate appearing for the petitioners submits that although Maheshtala Municipality issued two notices, dated May 14, 2024, and May 17, 2024, against respondent nos. 6, 7, and the petitioners, respectively, the Municipality has not yet concluded the proceedings.

In response, the learned advocate for respondent nos. 6 and 7 asserts that the said respondents are unaware of any such notices.

I am not inclined to keep this writ petition pending. In WPA 13772 of 2024, this Court previously observed that the Municipality is at liberty to take appropriate steps concerning the relevant construction in accordance with the law.

In light of the above, I am of the view that Maheshtala Municipality should expeditiously conclude the proceedings based on the notices dated May 14, 2024, and May 17, 2024, in accordance with the law.

Accordingly, this writ petition is disposed of with a direction to Maheshtala Municipality to conclude the proceedings initiated on the basis of the aforementioned notices as expeditiously as possible, preferably within three months from the date of communication of this order. The Municipality shall hear both the petitioners and the respondents afresh and pass a reasoned order, which shall be communicated to the parties.

Accordingly, WPA 15048 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
