1. In pursuance of the direction passed by this Court dated 16.05.2024 a communication was made to the Superintendent of Police Hooghly.
2. The concerned Police Station was directed to produce the appellant and the opposite parties before the Court on the next date of hearing by the order dated 16.05.2024. Although the Superintendent of Police, Hooghly was informed about the said direction of this Court but no compliance report has been received to that effect.
3. The instant appeal is preferred at the behest of the complainant/petitioner challenging the impugned judgement and order of acquittal against the opposite parties by the Trial Court.
4. Being aggrieved by and dissatisfied with the said order of acquittal the instant criminal appeal has been preferred on behalf of the complainant/ petitioner.
5. Today the appellant is present before this Court through his learned advocate and submits that he does not intend to proceed further with the present appeal. A written petition is filed to that extent by the said appellant/complainant.
6. The Vokalatnama filed by the learned advocate on behalf of the appellant be kept with the record.
7. As the appellant/complainant does not intend to proceed further with the present appeal, I find there is no impediment in dismissing the present appeal.
8. Accordingly the instant appeal being CRA 288 of 2000 is hereby dismissed.
9. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities. (Prasenjit Biswas, J.)
