Records of the writ petition reflects that Title Suit M/L. No.647 Rakib no.564/23 was pending before the learned Civil Judge (Senior Division), 3rd Court, Krishnagar, Nadia. The grievance of the petitioner was even after such Title Suit was pending, construction has been proceeding which was to the detriment of the petitioner.

State has submitted a report. Report reflects that number of criminal cases has been instituted. There are proceedings under Section 144 Cr.P.C. as well as under Section 107 of Cr.P.C.

Learned advocate for the private respondents disputes and denies the contention.

Having considered that the Civil Court is already in seisin of the issue, police authorities would only oversee that in case any information is furnished relating to breach of the peace and/or tranquility they would take steps in accordance with law.

With the aforesaid observations WPA 14978 of 2024 is disposed of.

Report so submitted by the State be kept with the record.
