Learned counsel for the petitioners submits that there was a land dispute between the parties. On account of which the petitioner falsely implicated. Learned counsel submits that there is a delay in registration of FIR. learned counsel submits that the petitioners shall join the investigation as and when directed by the I.O.

Learned counsel for the State has opposed the bail application stating that Section 8 of the POCSO has been added it by the order of Ld. CJM, Hooghly Sadar. Learned counsel further submits that accused persons had tried to strangulate a minor girl as been revealed from the FIR.

The Court has considered the submissions. The alleged incident occurred on 2nd April, 2025 and the FIR was lodged on 5th April, 2025. The FIR itself says that there was a previous enmity between the families. As per the injury report there was no external injury. Let the petitioners join the investigation as and when directed by I.O.

In the event, if Investigating Officer feels necessary of effecting the arrest of the petitioners they be admitted to anticipatory bail by furnishing personal bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of like amount each, one of whom shall be local, to the satisfaction of the Investigating Officer/Arresting Officer however till the time the investigation is not complete and charge sheet is not filed, the petitioner shall not enter the jurisdiction of P.S. Balagarh, Hooghly.
