\ ...for the State. Learned advocate for the petitioner submits that the petitioner is in custody for about 98 days and the investigation of the case has been concluded. As such, according to him, the petitioner being a person aged about 67 years may be released on bail on any condition.

Mr. Roy, learned advocate, appears for the State and produces the case diary. Attention of the Court has been drawn to the statement of the victim under Section 164 of the Code of Criminal Procedure as well as the medical documents. I have checked the medical report and I find that prima facie there is some corroboration in the statement of the victim and that recorded by the doctor. Having considered the same, I am of the opinion that at this stage, the petitioner should not be released on bail. Accordingly, his prayer for bail is rejected. Learned advocates appearing for either of the parties

submit that the last date was fixed on 26th June, 2023 for charges. In case the charges have not been framed till date, the learned trial court would on the next date so fixed complete the process of framing of charges and complete the evidence of the victim by 30th August, 2023.

Petitioner is granted liberty to approach this Court immediately after the evidence of the victim is over. Accordingly, CRM (SB) 137 of 2023 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
