1. The petitioner has made out a prima facie case of contempt insofar as in violation of the order dated September 08, 2023 passed in WPA 12864 of 2019 is concerned, since the alleged contemnor has not refunded the excess amount of stamp duty deposited by the petitioner.

2. Accordingly, the petitioner shall serve a copy of the contempt application on the alleged contemnor indicating that the matter shall be listed on February 09, 2024 under the same heading, when an affidavit-of-service in that regard shall be filed by the petitioner.
