On careful perusal of the instant revision considering the submission made by the learned advocate for the petitioner, this
Court is of the view that the instant revision can be disposed of here and now with the assistance of the learned advocate for the State. Ms. Faria Hossain along with Ms. Manisha Sharma, learned P.P.- in-charge are requested to assist this Court in the instant matter. The petitioner has approached this Court for a direction for expeditious disposal of NDPS Case No.N.95 of 2020 pending before the learned Additional Sessions Judge, 6th Court at Barasat. It is stated by the learned advocate for the petitioner that he was arrested on 29th April, 2020 in connection with Bagdah Police Station Case No.237 of 2020 dated 29th April, 2020 under Section 21 (c) of the NDPS Act. After filing of the charge sheet and supplementary charge sheet by the Investigating Officer the trial Judge framed charge against the petitioner on 15th September, 2021. When the petitioner pleaded not guilty, the case was taken up for trial. On 14th February, 2022 only one witness out of nine charge sheeted witness was examined. Next date is fixed on 4th and 5th August, 2022.
Under such circumstances, it is submitted on behalf of the petitioner that as the petitioner is languishing in Correctional Home, the trial Court may be directed to dispose of the matter expeditiously. It appears that only eight witnesses are remaining for examination. The learned trial Judge is requested to take positive
step for examination of at least five witnesses on 4th and 5th August, 2022. Subsequently, he shall fix a schedule for examination of remaining three witnesses in the month of November, 2022 so that hearing may be concluded and judgment may be passed by the month of December, 2022.
The instant revision is, thus, disposed of.
