Imtiaj Uddin ..for the petitioner The petitioner is aggrieved by the inaction of the Joint Secretary to the Government of West Bengal, Department of Panchayats and Rural Development. It is alleged that a recommendation was made by the Additional Director of Panchayat & Rural Development, West Bengal on January 19, 2021, for appointment of the petitioner on compassionate ground. The petitioner was placed at serial no.1399. No intimation has yet been supplied to the petitioner, with regard to fate of the proposal. It is contended by the petitioner that the persons who had been placed below the petitioner in the proposal/list, had been granted appointment. The seriality in the recommendation, was violated. The Joint Secretary to the Government of West Bengal, Department of Panchayat Rural Development, shall dispose of the prayer of the petitioner for appointment on compassionate ground and intimate the status of the recommendation, by passing a reasoned order. In the reasoned order, the

Joint Secretary to the Government of West Bengal, Department of Panchayat Rural Development shall indicate whether the list is being exhausted as per serial number of the proposed candidates. The serial number of the last candidate who was appointed from the list, shall be made available to the petitioner. There is no dispute that a proposal for appointment of the petitioner was sent and the petitioner was placed at serial no. 1399 of the said list. The issue of breaking the serial number, must also be enquired into.

The entire exercise shall be completed within a period of four months from the date of communication of this order.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
