Learned counsel for the petitioners submits that after the earlier pre-arrest bail of the petitioners were rejected by this court vide order dated 7th May, 2025 in CRM (A) 905 of 2025. The matrimonial disputes between the parties have amicably settled. The settlement has been filed in Matrimonial Suit No.252 of 2025 before the learned Principal Judge, Family Court at Bankura. Learned counsel submits that the joint compromise deed was filed signed by petitioner/husband and de facto complainant/wife. Learned counsel submits that, therefore, in view of change of circumstances may be admitted to pre-arrest bail.

Learned counsel for the de facto complainant submits that parties have reached on an amicable settlement and they have resolved all their disputes.

Learned counsel for the State also submits that they have verified the settlement arrived in between the parties. 4.

The present case has arisen out of the matrimonial dispute between the parties. Since the parties have settled the dispute and filed the settlement before the learned Judge, Family Court, Bankura.

The court considers that there are change in circumstances and the petitioners may be admitted to anticipatory bail upon furnishing a personal bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Cr.P.C., 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall cooperate with investigation and shall not threaten or intimidate witnesses. 6.

The application for anticipatory bail is, thus, allowed. 7.

All parties shall act on the basis of the server copy of this order.
