The petitioner is the widow of Saiful Islam who was appointed to the post of Gram Panchayat Karmee on and from 5th February, 2002. He died in harness on 30th June, 2019. The petitioner applied for compassionate appointment before the concerned authority on 25th November, 2019 and sent a subsequent reminder to the authority on 25th January, 2021. In response thereto, the Block Development Officer, Domkal by a letter issued on 5th April, 2022 requested the petitioner to submit certain documents in support of her claim within 15 days thereof.

Learned counsel for the petitioner submits that despite submission of such documents within the prescribed time, the matter is still pending before the concerned authority. The petitioner seeks compassionate appointment. Upon consideration of the submission made on behalf of the petitioner, this Court is of the view that since the application for compassionate appointment has been taken up for consideration by the authority and the documents called upon by the authority has been submitted by the petitioner, the concerned authority being the Block

Development Officer, Domkal, the 6th respondent herein, is directed to consider the application and documents submitted by the petitioner and take the matter to its logical conclusion within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
