This writ petition has been filed by the petitioner on the ground of alleged inaction on the part of the respondents/Electricity Authority in providing electricity connection to the petitioner in spite of compliance of legal formalities.

Learned Advocate appearing for the respondents/Electricity Authority submits that due to obstruction by the private respondent no electricity connection could be provided. Private respondent is not appearing in the matter. The private respondent has not appeared at the time of moving the writ petition in spite of service. Further opportunity was given to the private respondent by service of notice upon him by the order of this court dated 19th September, 2023, and in spite of the second notice, private respondent is not appearing.

Considering the facts and circumstances of the case and submission of the parties respondents/Electricity Authority concerned is directed to provide electricity connection to the petitioner if petitioner has fulfilled all the conditions required under the law, within a period of four weeks from the date of communication of this order and if the Electricity Authority faces any obstruction by the private respondent in such case they will be free to take Police assistance at the cost of the petitioner. Needless to mention that if the Electricity Authority approaches the Police Authority concerned for any assistance, they will be bound to provide assistance. With this observation and direction this writ petition being WPA 14082 of 2023 is disposed of. ( Md. Nizamuddin, J. )
