Mr. Anupam Mukherjee, the son of the appellant is present in court and submits that his father, Arup Kumar Mukherjee has expired on 04.01.2011. His personal appearance be dispensed with.

The report submitted by Mr. Ajay Kr. Saha, S.I. of Shyampukur Police Station, DistrictCalcutta dated 18.4.2023 to the office of the learned Registrar Administration (L & OM) stating that the appellant, Arup Kr. Mukherjee has expired on 4.1.2011 supported by a copy of the death certificate be kept on record.

Under such circumstances, the instant criminal appeal gets abated and accordingly disposed of. (Ananya Bandyopadhyay, J.)
