Ms. Nibedita Chakraborty ...for the petitioners Mr. Ayan Banerjee Mr. Amrita Lal Chatterjee ...for the State The grievance of the petitioner is directed against an alleged illegal and improper flagging on the petitioner's property under Section 6(3) of the West Bengal Estate Acquisition Act, 1953. The petitioner also complains of the enhancement of land revenue in respect of subject premises.

It is submitted on behalf of the State that both the points raised by the petitioner are barred under the West Bengal Land Reforms Act and Tenancy Tribunal Act, 1997. It is also submitted by the State that the petitioner has alternative efficacious statutory remedy in respect of both the grievances of the petitioner which can only be appropriately adjudicated by the Tribunal.

In such view of the matter and in view of the efficacious alternative statutory remedy, WPA

14970 of 2024 stands dismissed on the ground of maintainability.

Liberty is granted to the petitioner to raise all available points in accordance with law before the Appropriate Authority.
