In Re: An Application under Section 482 read with Section 401 of the Code of Criminal Procedure, 1973 filed for challenging the order dated 30.04.2018 passed by the learned Chief Judicial Magistrate, Howrah in M.P. Case No. 66 of 2018 dated 30.04.2018.

The present revisional application has been preferred challenging the order dated order dated 30.04.2018 passed by the learned Chief Judicial Magistrate, Howrah in M.P. Case No. 66 of 2018 dated 30.04.2018. The subject matter of challenge relates to an order rejecting the prayer of the petitioner under Section 156(3) of the Code of Criminal Procedure.

I have perused the order passed by the learned Chief Judicial Magistrate, Howrah which reflects the assessment of facts as well as the law relating to the decision of the Hon'ble Supreme Court in Priyanka Srivastava & Anr. Vs. State of Uttar Pradesh & Ors. reported in (2015) 6 SCC 287. Considering the nature of assessment made as well as the reasons so assigned, I am of the opinion that no interference is called for.

Accordingly, the revisional application being CRR 2038 of 2018 is dismissed.

All pending connected applications, if any, are consequently disposed of.
