....for the State The prosecution case is that 501 grams of heroin was recovered from the possession of the present petitioner and he is in custody for about three and half months.

He further submits that the investigation in respect of the present petitioner has been advanced to a considerable extent and as such, his further detention may not be required and as such he may be released on bail on any terms and conditions. Learned counsel appearing on behalf of the State opposed the bail prayer contending that the commercial quantity of narcotic substance was recovered from the possession of the present petitioner and the investigation is still in progress.

Having heard the learned counsel on behalf of the petitioner and the State it appears that the petitioner failed to overcome the restrictions imposed under section 37 of the NDPS Act and as such prayer for bail is considered and rejected. CRM (NDPS) 767 of 2025 is disposed of.

Urgent certified copy of this order, duly applied for, be given to the parties upon compliance with all requisite formalities.
