1. The affidavit filed by the Assistant Director of School Education, West Bengal in terms of the order dated 9th August, 2023, is taken on record. The report shows that there are two nearby vacancies.

2. Mr. Shuvro P. Lahiri, learned Counsel appearing on behalf of the appellant submits, on instruction, that the prayer of the appellant may be considered for the Bhatpara Amarkrishna Pathsala (H.S.).

3. In view of the aforesaid submission, we direct the District Inspector of Schools (S.E.), Barrackpore, North 24 Parganas to forward the name of the appellant for the Bhatpara Amarkrishna Pathsala (H.S.) to the West Bengal Central School Service Commission for recommendation and consequent upon the recommendation, the Board shall issue the transfer order.

4. The entire process shall be completed within a period of four weeks from date.

5. In view of the changed circumstances and the stand taken by

the State in terms of our earlier order, the impugned order is set aside. As a consequent whereof, the administrative order passed during the pendency of the appeal, is also set aside.

6. The appeal is, accordingly, disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
