This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge, Junior Division, 1st Court at Contai to dispose of the of the Title Suit No. 97 of 2021 expeditiously.

In view of the order sought to be proposed, there is no necessity to issue notice upon the opposite party. However, learned Advocate on record for the petitioner shall be obliged to forward a copy of this application upon the opposite party or upon the learned Advocate who represents the opposite party before the learned Trial Court.

This Court finds that an application under Order 6 Rule 17 of the Code of Civil Procedure was allowed by an order dated 1st March, 2025 and 2nd August, 2025 has been fixed for filing of the amended plaint.

In view thereof, the learned Civil Judge, Junior Division, 1st Court at Contai is requested to make all endavours to see that the Title Suit No. 97 of 2021 is disposed of as expeditiously as possible without granting unnecessary adjournments to either of the parties.

CO No. 2215 of 2025 stands disposed of.
