The petitioner complains that he has already approached the learned ACJM, Diamond Harbour as also the learned Sessions Court by invoking the appropriate provisions of law, but, could not convince the courts as the name of the petitioner was claimed by the State as not appearing from the materials collected by the police authorities.

Today, a report has been

submitted on behalf of the State which primarily reflects that the police authorities claim complicity of the present petitioner as suspect.

Having considered the same and as the present petitioner has already approached the learned ACJM, Diamond Harbour for appropriate relief under the relevant provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015, I direct the learned ACJM, Diamond Harbour to assess regarding the documentary evidence in support of the claim of the present petitioner's son, thereafter, pass necessary directions if he/she is satisfied for the police authorities to act inconsonance with the provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015.

However, it would be the discretion of the learned ACJM, Diamond Harbour to first assess regarding the age of the child whether he is a minor and/or

major, thereafter, take recourse to the provisions of law.

Accordingly, I direct the learned ACJM, Diamond Harnour to entertain and dispose of the application in accordance with law, which has been filed earlier by the petitioner and was not entertained as has been claimed by the petitioner.

With the aforesaid observations, WPA 13884 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
