Supplementary affidavit filed by the petitioner is taken on record.

It appears from the final report that there are several omissions on the part of the investigating officer. Except for tracing out the tower location of the accused, the other parts of the role of the accused in the alleged offence have not been gone into.

The appellant did not have confidence on the police to undergo a medical examination under them.

In view of the matter, this Court is of the view that interest of justice would be served if the investigation is transferred from the State police to the C.I.D., West Bengal. The Amherst Street Women Police Station shall handover all papers in relation to the Amherst Street Women Police Station FIR No.7 of 2022 to the head of the C.I.D., West Bengal located at Kolkata for investigation. 5.

The petitioner undertakes before this Court to cooperate extensively in the investigation.

It is expected that the C.I.D., West Bengal treats the matter with the sensitivity it deserves. It is expected that the investigation by the C.I.D., West Bengal shall be completed within four months from date.

The objections raised by the counsel for the accused need not be gone into by this Court in view of the settled decisions of the Supreme Court.

With the aforesaid observations, WPA 13985 of 2023 is disposed of.

In view of the above, CPAN 1166 of 2023 is also disposed of. Consequently, all connected applications, if any, are also disposed of.

Rule, if any, shall stand discharged.

There shall be no order as to costs.
