Ct. 29 Vs. The State of West Bengal Mr. B. Chatterjee Mr. Yash Raj Roy Ms. Sabera Khatun Ms. Ayesha Najrin Ms. Khadija Khatoon ... for the petitioners. This is an application wherein petitioners have prayed for expeditious disposal of G.R. (E) Case No. 756 of 2015 dated presently pending before learned Judicial Magistrate, 1st Class (1st Court) Contai, Purba Medinipur.

Petitioners' contention is that in the instant case the FIR was registered in the year 2015 and charge-sheet also submitted in the same year. The charge has been framed against the present petitioners in the year 2022 but till date only one witness could be examined and as such they are suffering a lot due to long pendency of the case.

Having heard learned counsel for the petitioners, I find that the prayer made by the petitioners for direction upon the Magistrate for expeditious disposal of the case is innocuous and if any order is passed in terms of the said prayer made by the petitioners the opposite party will have no cause to prejudice and as such the service of copy of application upon the opposite party is dispensed with.

Having heard learned counsel for the petitioners and that the proceeding is pending for last 10 years, I find that the prayer made by the petitioners is justified and therefore invoking this Court's jurisdiction under section 483 Cr.P.C. read with section

529 of the BNSS the learned Magistrate is directed to make every endeavour for expeditious disposal of the case and to conclude the entire proceeding preferably within a period of six months from the next date of hearing.

CRR 2683 of 2025 is accordingly disposed of.
