1. Learned counsel for the petitioner submits that it was a consensual relationship and on account of some misunderstanding FIR was lodged. Learned counsel submits that the victim in her statement under Section 164 Cr.P.C. has stated that she had left her home voluntarily.

2. Learned counsel for the de facto complainant also submits that the victim had gone at her own wish along with the petitioner.

3. Learned counsel for the State has fairly submitted that the victim exonerated the petitioner in her statement under Section 164 Cr.P.C. The victim admittedly is minor but more than 16 years of age. The petitioner is stated to be 23 years of age.

4. Taking into account, in the event of arrest, the petitioner shall be released on anticipatory bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and on subject to the condition that the petitioner shall not threaten or intimidate the prosecution witnesses. The petitioner shall stay outside the jurisdiction of Gangarampur Police Station for a period of four months from this date, except for attending court or meeting the Investigating Officer.

5. Thus, the prayer for anticipatory bail is allowed.

6. CRM (A) 2149 of 2025 is disposed of.

7. Urgent Photostat certified copy of this order be given to the parties upon compliance with all necessary formalities. ( Dinesh Kumar Sharma, J. )
