Mr. Soumitra Mukherjee Mr. Debraj Sahu ... for the State The petitioner prays for a direction upon the Maheshtala Municipality for consideration of her representation made seeking allotment of dwelling house within the Maheshtala Municipality under any of the schemes of the government, either Central or State. The said representation was filed on 26th November, 2021. The petitioner alleges that the same has not been taken up for consideration till date. None appears on behalf of the Municipality despite service.

There is no proof of service of the said representation upon the Maheshtala Municipality though the proof of service is upon the District Magistrate and Collector as well as in the office of the Sub Divisional Officer.

In view of the above, the instant writ petition is disposed of by granting liberty to the petitioner to apply before the Maheshtala Municipality praying for redressal of her grievances.

In the event an application is made before the Municipality, the same shall be considered strictly in accordance with law, at the earliest but positively within a period of eight weeks from the date of communication of this order.

The Municipality, if required, may grant an opportunity of hearing to the petitioner to file documents in support of her prayer.

Affidavit of service filed in Court is taken on records.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
