It appears that the application for recall is not within time but the grounds for delay has been noted in the CAN application.

Considering the grounds as made out and on hearing the parties and in the interest of justice the order dated 19.12.2023 is recalled.

Writ application 13095 of 2018 is restored to its own file and number.

Later At this stage learned counsel for the petitioner submits that there was a written prayer by the petitioner's advocate praying for withdrawal of the writ

application on the ground that the issue in the present case had been settled out of Court.

Accordingly on prayer of the petitioner the writ application stands disposed of as withdrawn.
