The present revisional application was preferred by the accused with a prayer that there has been change of circumstances and the parties intend to settle their disputes. This Court by its order dated 21st November, 2022 called for a report from the Inspector-in-Charge, Mahishadal Police Station which include a statement being recorded that of the complainant/opposite party no.2.

Today, a report has been submitted by Mr. Nandy, learned advocate appearing for the State. The report states that the complainant/opposite party no.2 is not interested in withdrawing the case, which was filed. To that effect, a written communication has been sent to the Officer-in-Charge of Mahishadal Police Station. Let the report be kept with the record.

The basis on which the present revisional application was filed is on a wrong notion and, as such, the same do not survive. However, if situation so demands the petitioner would be at liberty to approach this Court.

With the aforesaid observations, CRR 1892 of 2021 is disposed of.

The Investigating Agency is directed to proceed with the investigation of Mahishadal Police Station Case No.114 of 2020 dated 20th June, 2020 and take the same to its logical conclusion. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
