Mr. Soumik Ganguli Mr. Arani Bhattacharyya ...... for the State Petitioner is in custody for more than two years. He submits no narcotic substance was recovered from his possession. He renews his prayer for bail.
Learned lawyer for the State opposes the prayer for bail. He submits on his leading statement recovery of narcotic substance i.e. 60 bottles of phensedyl syrup was recovered. We have considered the materials on record. On the leading statement of the petitioner i.e. 60 bottles of phensedyl syrup was recovered. Recovery was witnessed by independent persons. In view of the aforesaid incriminating materials and his prayer for bail was rejected earlier, we are not inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected. ( Ananya Bandyopadhyay, J. ) ( Joymalya Bagchi, J.)
