Learned counsel for the petitioner submits as follows. The petitioner is a self-financed nursing institute conducting courses of BSC nursing and GNF for women. It has an annual intake capacity of 60 students. The petitioner has got all required sanctions and permissions from the statutory authorities including from the Indian Nursing Council. It has been noticed that for sometime the interest of women in pursuing such course had been waning. In view of the same, the petitioner has applied before the Directorate of Health Services, Nursing Section to allow the course to be carried out not only for female, but also for male students. A communication was made subsequent to the filing of the writ petition that the authorities would be undertaking necessary inspection

for such purpose. However, after the writ petition became pending, the authorities have put the process on hold. This was communicated to the petitioner. Learned counsel for the State submits that a process of inspection had already begun pursuant to the prayers made by the petitioner that the petitioner would like to impart education to male students as well.

In view of the fact that pursuant to the request made by the petitioner, the State had already initiated a process for inspection for granting necessary permission, the writ petition is disposed of by granting liberty to the authorities to take appropriate steps in conducting such inspection and coming to a decision to grant permission to the petitioner to permit such course in accordance with law.
