Subrata Chakraborty v. State Of West Bengal & ANR
26.08.
CRR 2314 of 2011 Subrata Chakraborty Vs.
The State of West Bengal and another.
Item No.13 Court : 40 Ab Mr. Soumik Ganguli.
... for the petitioner.
Mr. Manoranjan Mahata.
... for the State.
Heard Mr. Soumik Ganguli, learned Counsel appearing on behalf of the petitioner.
The grievance of the petitioner is that quantum of maintenance, which was enhanced from Rs. 1200/- to Rs. 2500/- per month in terms of the impugned order dated 1st March 2011 in Miscellaneous Case No. 16 of 2010.
Mr. Manoranjan Mahata, learned Counsel appearing on behalf of the State submitted a report. Let the same be kept with the record. He submitted that considering the fact that the impugned order was passed in the year 2012, the quantum of Rs. 2500/- is, in fact, a kind of pittance and it should be enhanced.
Let the appointment of Mr. Mahata be regularized. None appears on behalf of the opposite party/wife. On perusal of the materials on records and the application it appears that an amount of Rs. 2500/- in perspective of the present day is in a lower side. Such amount should not be reduced. Therefore, this Court refrains from interfering with the impugned order.
Accordingly, the instant application stands dismissed on merit. (Sugato Majumdar, J.)
