1. Let affidavit-of-service, as filed in Court, be kept on record.

2. The petitioner challenges the acts of commission and/or omission of the respondent, Co-operative Society. Even though such action has been challenged previously, sometime in 2014, the same was disposed of by an order dated December 6, 2018, directing the petitioner to approach the general body in the light of the Rule 106 of the West Bengal Co-operative Societies Rules, 2011.

3. Mr. Panja, learned Advocate appearing for the petitioner, submits that at the material point of time there was no Board in place and there is no

question of consideration of these issues by a nominated Board.

4. He further submits that presently there is a duly elected Board in place.

5. Leave is granted to the petitioner to approach this Board with his grievances, which will be duly considered in the light of the Rule 106 of the West Bengal Co-operative Societies Rule, 2011, within a period of eight weeks from the date of filing of the representation by the petitioner.

6. The order is passed without getting into the issue of maintainability of the writ petition.

7. With these aforestated directions, the writ petition is disposed of.

8. There shall, however, be no order as to costs.

9. Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
