The award of interim maintenance has been affirmed by the learned Sessions Judge, Howrah. A huge amount of arrears are pending. In view of the undertaking given by the learned advocate appearing for the petitioner that the petitioner would clear the arrears by way of three instalments, I direct that in case the arrears which have been calculated by the learned Judicial Magistrate, 3rd Court, Howrah in connection with Misc. Case No. 246 of 2021 and 1/3rd of such arrears is paid by 27.06.2023, another 1/3rd of the amount is paid by 27.07.2023 and rest of the amount is paid by 27.08.2023, the execution case would be dropped. After the payment of 1/3rd of the amount so fixed by the learned Judicial Magistrate by 27.06.2023, the execution of the warrant of arrest be kept in abeyance till 28.07.2023. After the amount is paid on 27.07.2023, the execution of the warrant of arrest be kept in abeyance till 28.08.2023 and after the rest of the amount is cleared by the petitioner on 27.08.2023, the warrant of arrest issued against the petitioner be recalled by the learned Magistrate.

With the aforesaid observations, the revisional application being CRR 2163 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties including the learned Trial Court shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
