Md Mirajuddin Sk And ORS v. State Of West Bengal And ORS.
31.08.2022 Court No. 19 Item 667(ML) CP WPA No. 14097 of 2022 Md. Mirajuddin Sk. & ors.
Vs.
The State of West Bengal & ors.
Mr. Subhajit Panja ...for the petitioners.
Mr. Ankit Surekha Mr. Biplab Das Mr. Paretho Pal ....for the respondent nos. 3 & 4.
Mr. Pradip Kumar Roy Mr. Joydeep Roy Ms. Susmita Chatterjee ...for the State.
Mr. Srijan Nayak Mrs. Rituparna Maitra ...for the respondent no. 2.
The only grievance of the petitioners who are the members of Baranagar Samabay Krishi Unnayan Samity Ltd. (hereinafter referred as 'the said society'), is that although the life of the board of directors of the said cooperative society expired on June 6, 2022, the respondents, specially the Cooperative Election Commission, have not taken any steps for holding the election.
Learned advocate for the Commission submits that the preparation for holding the election had
been initiated. The Assistant Returning Officer was appointed. The final voters' list has been published. Under such circumstances, the writ petition is disposed of with a direction upon the said respondent to conclude the process of election of the said society forthwith, preferably within a period of three months from the date of communication of this order.
The writ petition is accordingly disposed of. There shall be no order as to costs.
Parties are to act on the server copy of this order.
