Learned counsel for the State has filed the English translated copy of the statement recorded under in vernacular language 2.

Perusal of the testimony of the victim indicates inconsistencies and contradictions in her statement under 164 Cr.P.C., where the victim has not even spoken about attempt to rape. The charge-sheet has already been filed. There nothing has been brought to the notice of this court that any attempt was made to arrest the petitioner during the course of investigation. 3.

In the facts and circumstances, let the petitioner be admitted to pre-arrest bail on furnishing a personal bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local. Subject to the further conditions that the petitioner shall meet the Investigating Officer as and when called

and shall not threaten, tamper or intimidate the prosecution witnesses in any manner.

The application for anticipatory bail is, thus, allowed. 5.

All parties shall act on the basis of the server copy of this order.
