The writ petitioner claims that the private respondents have illegally effecting construction over his land, inter alia, by dumping mud.

The private respondents want to construct a road thereon.

It is submitted by the Counsel for the petitioner that after filing of the instant writ petition, a civil suit has been filed.

This Court is of the view that the remedy of the petitioner is before an appropriate civil forum. In those circumstances, no relief can be granted to the petitioner in this writ petition.

The Inspector-in-charge, Haroa Police Station shall only ensure that there is absolutely no breach of peace in the area and comply with any direction passed by the Civil Court.

The writ petition shall stand disposed of.

There will be no order as to costs.
