By the impugned order, learned Single Judge noticing that the writ petition was the third at the behest of the writ petitioner, proceeded to dismiss the same with the cost of Rs.5,100/-.

Learned advocate appearing for the appellant submits that the writ petitioner is a Constable of the Central Industrial Security Force (CISF). The husband of the appellant is a Sergeant with the Kolkata Police and posted at the Gariahat Traffic Guard. There is a child born out of the wedlock who is about 6 years old. He refers to

the Central Government Circular and contends that ideally spouses should be posted at the same place so that the marital life of spouses is not disturbed. He submits that, for the ends of justice such policy decision of the Central Government should be implemented to ensure that the appellant is posted in Calcutta.

Union of India is represented.

Appellant is a Constable of CISF while her husband is a Sergeant of Kolkata Police. Two Organizations are different. Their service conditions are different. Service conditions of the appellant cannot be utilized so as to accord the benefit as sought for by the appellant herein. In such circumstances, we find no merit in the present appeal.

M.A.T. 1121 of 2024 is dismissed.

In view of the dismissal of the appeal, the connected application being CAN 1 of 2024 is disposed of. Learned advocate appearing for the appellant will file the Certified Copy of the impugned order in the department in course of the day.
