Affidavit-of-service filed in Court today be kept with the records.

The petitioner is aggrieved by the order dated 23rd April, 2025 passed by the Chief Wildlife Warden, West Bengal & Management Authority.

The said order is an appealable one and it has been disclosed in the impugned order that the appeal lies with the Ministry of Environment, Forests and Climate Change, Government of India within sixty days in terms of Rule 10 of the Living Animal Species (Reporting and Registration), Rules, 2024.

Learned advocate for the petitioner submits that no specific authority has been designated in the Ministry before whom the appeal may be filed. 5.

The petitioner also prays for an interim order restraining the Authority from taking coercive steps

against the exotic birds which the petitioner is possessing.

The Court is of the opinion that the appeal be preferred before the Authority as mentioned in the impugned order. It will be open for the petitioner to pray for interim relief before the appellate authority. 7.

The Court is not inclined to exercise jurisdiction in this matter at this stage.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
