Learned counsel for the State has filed the report of SI, Manorajan Murari, Sagarpara P.S., let it be taken on record. 2.

Perusal of the report indicates that there is no communication found between the petitioner and other accused persons as per CDR. The report also says that there is no money trail between the petitioner and other accused persons. The only evidence against the petitioner is that he has been named by coaccused Aijul Sheikh as well as BSF raid parties. Co-accused Montu Mondal has been admitted to bail by the co-ordinate Bench of this Court in CRM (A) 2179 of 2025.

Perusal of the order dated 11th July, 2025 in CRM (A) 2179 of 2025 indicates that the only material available against the coaccused was a statement of co-accused. The co-ordinate Bench

found that the co-accused was able to rebut the restriction contained in Section 37 of the NDPS Act. The present petitioner is identically placed.

Accordingly, in the event of arrest, the petitioner, Habibur Rahaman @ Rentu shall be released on bail upon furnishing a personal bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of Arresting Office and subject to the conditions as laid down under Section 482 of the BNSS and on further condition that the petitioner shall attend the Special Court regularly and shall surrender before the Special Court within four weeks and pray for bail and the petitioner shall not threaten or intimidate witnesses. 5.

The application for anticipatory bail is, thus, allowed. 6.
