This appeal is directed against an award dated 8th December, 2016 passed by learned Judge, 11th Bench, City Civil Court, Calcutta in MAC case no. 269 of 2010 (Bholanath Sarkar vs. Bajaj Allianz General Insurance Company Limited & Ors.).

Pursuant to an earlier direction of this Court, the parties were requested to attempt to amicably resolve the matter.

It is submitted by the parties that they have been able to resolve their disputes.

It appears that by way of separate deposits a sum of Rs. 3,00,645/- is lying with the Registrar General of this Court.

It is submitted by the learned advocate for the claimant that his client is ready and agreeable to

receive the said amount along with accrued interest as full and final settlement of his dues.

The Registrar General of this Court is directed to pay the aforesaid sum along with accrued interest to the claimant/respondent within four weeks from date. The Registrar General is directed to ensure the physical presence of the claimant and be satisfied about his identity and upon proper and valid identification being produced by the claimant. With the aforesaid directions, FMAT 620 of 2017 and the interlocutory applications stand disposed off. (Ravi Krishan Kapur, J.)
