WPA 15114 of 2024 (Raja Sk vs. State of West Bengal & Ors.) Mr. Suman Ghosh ... For the State The petitioner is aggrieved by the fact that only for default in respect of two instalments the financier being the respondent no. 9 through their agents forcibly took away the vehicle.

State has submitted a report.

Report reflects that there was a hot altercation at the time of recovery of possession of the vehicle. However, taking into account that disputes and differences arose at the time of recovery of possession of the vehicle, the police authority refrained from taking any steps.

Having considered that the petitioner and the private respondents are known to each other and there was relationship arising out of hire purchase agreement, I direct that in case the offence has allegedly been committed, the petitioner would approach the jurisdictional Magistrate for appropriate direction. With the above observations, the writ petition being W.P.A. 15114 of 2024 is disposed of.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.
