Affidavit of service filed by the petitioners is taken on record.

Service has been effected only on the State.

However, since the innocuous prayer of the petitioner is for expeditious disposal of C.Spl. Case No.99 of 2022 pending before the learned Judge, Special Court (POCSO Act), Berhampore, Murshidabad the matter may be disposed of without service of notice upon the opposite parties.

Opposite parties shall not be prejudiced if an order for expeditious disposal of the matter is passed in their absence. Expeditious disposal of the matter shall in fact enure to the benefit of both the parties.

Heard learned counsels for the parties.

It appears that the petitioners are in custody since 3rd December, 2022 and charge is yet to be framed.

In view of the above, the learned Trial Court is directed to consider framing of charge on the next date fixed before him. In the event the same is not possible, such consideration may be made within one month from the said date.

Since the petitioners are in custody for considerable period of time, the learned Trial Court is directed to make all endeavours to dispose of the matter as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law. The revisional application being CRR 2249 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
