For the petitioner Having considered the submission of learned advocate for the petitioner seeking expeditious disposal of injunction application under Order 39 Rule 1 and 2 CPC,, the court is of the view that no prior notice is necessary upon the opposite party, in view of the nature of the order proposed to be obtained in this case.

Admittedly, the petitioner has been suffering interim injunction. The petitioner has already appeared in the court below by filing written objection against the injunction application.

In such context, learned court below is directed to ensure expeditious disposal of injunction application providing sufficient opportunities of hearing to either of the parties to this case, but without granting unnecessary adjournments, unless it is extremely unavoidable. Petitioner to make communication of this order to the opposite

party/plaintiff and his learned advocate appearing in the court below, apart from making independent communication of this order to the court below.
