Heard learned counsels for the parties.

The petitioner is in custody for more than a year and renews his prayer for bail.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated. The witnesses have prevaricated from their earlier statement made in course of investigation.

Learned counsel for the State opposes the prayer. I have considered the material on record. The statement of an eye witness implicates the petitioner as the person who dealt the fatal blow to the victim, thereby causing his death. 6 out of 19 witnesses have been examined. The petitioner is in custody for more than a year. Offence, if proved, shall attract mandatory life imprisonment.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
