The appellant workman challenges an order dated April 26, 2024 passed by the Hon'ble Single Bench. On the date when the said order was passed, the third installment payable to the workman under the Payment of Gratuity Act, 1972 has been received by the appellant. The Hon'ble Single Bench has only permitted the respondent employer to approach the Appellate authority to establish that the respondent has not worked for 33 years rather only 25 years. 2.

The appeal has been filed within the time stipulated by the Hon'ble Single Bench. The appellate authority shall strictly in terms of the mandate under the Act of 1972 decide the appeal of the appellant with due notice to the respondent within a period of three months from the date of communication of this order. Except as

indicated above no further order needs be passed in the appeal.

Hence, the appeal being MAT 1114 of 2024 is disposed of.

In view of the above, connected application being CAN 1 of 2024 shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
