Perused the report filed by the District Engineer, Southern District, CESC Limited, which is taken on record. The inspection was held by the CESC Limited. On inspection, it was found that the petitioner was not a consumer. The petitioner may have had a private arrangement with other persons, who have connections in their individual names. Seventeen live meters were found in the common meter board position and one was in disconnected condition. The CESC authorities are willing to process any application that the petitioner may file for grant of new commercial connection.

Under such circumstances, the writ petition is disposed of granting liberty to the petitioner to apply for new commercial connection, in accordance with law. If such commercial connection is applied for, the same shall be processed, in accordance with law. No one shall

disturb the CESC authority from doing its duties under the law.

If such connection is given, the same will not create any equity in favour of the petitioner. This order is not an adjudication on the right and status of the petitioner in respect of the property in question and will be subject to any other civil litigation that may be initiated against the petitioner, by the landlord.

4. Accordingly, the writ petition is disposed of.

5. All the parties are directed to act on the basis of the server copy of the order.
