as (Rejected) C.R.M. 6096 of 2021 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Nalhati P. S. Case No.272 of 2021 dated 11.08.2021 under Sections 448/326/307/436/506/120B/325 of the Indian Penal Code.
In the matter of : Raja Molla @ Nishar Molla. ... Petitioner.
Mr. Saibal Mondal, Mr. Rajendra nBanerjee, Ms. Nibedita Chakraborty.
...for the Petitioner.
Mr. Anowar Hossain, Ms. Ratna Ghosh.
.....for the State.
Heard the learned Advocates appearing for the parties. It is submitted on behalf of the petitioner that he is a student and has been falsely implicated in the instant case. Learned Advocate appearing for the State opposes the prayer for anticipatory bail.
We have considered the materials on record including the statement of the victim recorded in the medical papers implicating the petitioner as one of the persons who set the house on fire.
In view of the gravity of the offence and the prima facie involvement of the petitioner therein, we are of the opinion that this is not a fit case to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
