Learned counsel for the petitioner submits that the petitioner sought a new electricity connection for operating his submersible pump.

A report is filed by the WBSEDCL through counsel which indicates that at the time of inspection, several persons of the locality objected to the connection being given to the petitioner. A copy of the report be kept on record. Another copy of the same is handed over to the learned Advocate for the petitioner now.

The premise of such objection was primarily that they are the adjacent plot owners.

Since disputes of such nature are required to be adjudicated under the relevant Rules by the concerned District Magistrate of the locality, it would only be appropriate if the matter is referred to the said authority.

Accordingly, WPA 14068 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned District Magistrate having territorial jurisdiction in the area to obtain necessary orders from the Magistrate and resolution of the dispute between the petitioner and the objectors in that regard.

Upon such approach being made, the District Magistrate shall decide the issues in accordance with law and resolve the matter, preferably within eight weeks from the date of such approach being made by the petitioner.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
