Heard the learned Advocate for the appellants. 2.

Appellants had approached the Hon'ble Single Judge for recognizing him as the leader of opposition in Daulatnagar Gram Panchayat. Noting that the issue is pending consideration before the Commissioner, Panchayat and Rural Development Department, the Hon'ble Single Judge directed the said authority to consider the decision within a stipulated time frame. No final opinion has been expressed in the order impugned.

Under such circumstances, we are of the opinion the order impugned does not call for interference. 4.

Accordingly, the appeal and the connected application are dismissed.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the appellants on usual undertaking.
