Shantana Das v. State Of West Bengal And ORS.
20.01.2022 Court No. 19 Item no.13 sn WPA 14653 of 2021 Shantana Das Vs.
The State of West Bengal & Ors.
(Through Video Conference) Mr. Amit Roy ... for the Petitioner Mr. L.M. Mahata Mr. Rudranil De ..for the State Mr. Somesh Panja ..for the respdt.no.5 Report filed by the Block Development Officer, Gaighata Development Block, Chandpara, North Parganas is taken on record.
It appears that the petitioner was engaged by the Jaleswar-II Gram Panchayat on "no work no pay basis" and to maintain the register of MGNREGA. The said post was not sanctioned. The petitioner was engaged by way of a private arrangement. After the petitioner worked for some time, her engagement was discontinued, as there was a financial crunch in the office and the panchayat authorities could not pay her daily wages. There is no other reason why the petitioner was not given further work by the panchayat office.
The engagement of the petitioner was a private one. The petitioner was not engaged through any recruitment process to a sanctioned post. The
engagement was on "no work no pay basis" and as such the authorities have not curtailed or violated any right of the petitioner.
This Court does not express any opinion with regard to the competence of the petitioner and the authorities have not committed any illegality. The writ petition is, thus, disposed of. There shall be no order as to costs.
Parties are to act on the server copy of this order.
