The petitioner alleges non-payment of his legitimate dues upon completion of the work of construction of a pay and use toilet in Durgapur. The project was a part of the Green City Mission floated by the Government of West Bengal. The Durgapur Municipal Corporation was the executing body. It is submitted by Mr. Sandipan Banerjee, learned Advocate for the Durgapur Municipal Corporation that unless the Government releases the funds, the payment cannot be made. Here, 50% of the amount was already released to the petitioner. The remaining 50% of the bid amount should be released to the petitioner as a completion certificate has been

issued to the petitioner on March 16, 2023, which is at page 37 of the writ petition.

Under such circumstances, the writ petition is disposed of with a direction upon the Principal Secretary, Urban Development Department, Government of West Bengal to take necessary steps to release the funds immediately to the Durgapur Municipal Corporation upon Durgapur Municipal Corporation raising a demand towards the money payable to the petitioner, within a week from date. Upon receipt of such demand, the money shall be released to the Durgapur Municipal Corporation within a month and the Durgapur Municipal Corporation will accordingly disburse the money to the petitioner within a fortnight from receipt of the same All parties are directed to act on the basis of server copy of this order.
