Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. Learned counsel for the petitioner submits that the petitioner was granted maintenance by the learned trial Court under the Protection of Women from Domestic Violence Act despite which the private respondent who is her husband has not complied with the said order. A Misc. Execution case being no. 168 of 2024 was filed by the petitioner for execution of the order and warrant of arrest was issued against the private respondent who is a resident of Delhi. The petitioner alleges that the said warrant has not been executed by the Delhi police, being the respondent nos. 6 and 7 herein.

Upon consideration of the submission made on behalf of the parties, this Court grants liberty to the petitioner to approach the jurisdictional Magistrate for redressal of her grievance.

The writ petition is accordingly disposed of. There shall however, be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
